- 1). Contact your bankruptcy attorney, the same attorney that helped you file for chapter 13 bankruptcy, as soon as you become unable to make your monthly payment to your trustee.
- 2). Find Schedules I and J in your chapter 13 petition, and make copies of the schedules. Use blue or red ink to write in the updated figures. It will help to show the trustee that your financial circumstances have changed since you filed for chapter 13 bankruptcy protection. Submit the updated copies to your attorney along with the most recent year's tax returns. You need to provide the last six month's pay stubs, including the current month, for each working member in the household.
- 3). Make sure your attorney files a motion to convert. You need to pay a conversion fee, which may vary by district. Your attorney's office will notify all your creditors of the change in filing status.
- 4). Wait for a notification from your attorney. The bankruptcy court will either approve or deny your petition based on your current financial situation.
- 5). Attend the meeting of creditors, about 20 to 40 days after your conversion petition is filed. Your creditors are also informed and can attend this meeting. Expect to take an oath and answer questions regarding your financial situation.
